Turbo10 Limited may change any of the terms and conditions contained in this agreement and any other policies and guidelines governing the Terms of Service, at any time in its sole discretion. Notice of such changes will be posted on Turbo10 Limited's website (http://t10.com) and you are responsible for reviewing such notices. You agree that your continued use of the service following any changes to the Terms of Service will constitute your acceptance of such changes.

2. T10 Services
Turbo10 Limited offers search services to users of the Internet, providing a means of searching for information on the World Wide Web. These services include, but are not limited to: a metasearch facility - displays search results from multiple sources.

You may access the T10 Services free of charge. All content and services are provided by Turbo10 in good faith on an as-is basis.

By using the T10 Services you agree and acknowledge that Turbo10 Limited records information about the search that is conducted on the T10 Search Engine, such as: date of search, keywords, which result URL was clicked on, the IP address of the origin machine and that this information may be used for other services owned and operated by Turbo10 Limited and our sister company, Trexy Limited.

Turbo10 Limited also offers advertising on the site. The contractual relationship between Turbo10 Limited and the Advertiser are set out in a separate agreement: Advertiser Terms and Conditions and does not form a part of the T10 Services in this Terms of Service.

3. Content and Third Party Links
The T10 Services includes links to other World Wide Web sites or resources. Turbo10 Limited has no control over such sites and resources. You acknowledge and agree that Turbo10 Limited is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

The T10 Services automatically produces results that reference websites and content on the Internet. Turbo10 Limited cannot and does not screen the sites before including them in the search results. A search using T10 Services may produce results and links to sites that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a T10 search will not locate unintended or objectionable content and assume no responsibility for the content of any site included in any results or otherwise linked to by the T10 Services.

You further acknowledge and agree that Turbo10 Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. Finally, you acknowledge that such external sites usually have their own terms and conditions, including privacy policies, over which Turbo10 Limited has no control and which will govern your rights and obligations with respect to the use of those Web sites.

4. Non-Commercial Use
You are authorised to use the T10 Services for your personal use only and not for any commercial purpose. Personal use means that you may use the T10 Services at work or at home. You are not permitted to sell, modify, copy, license, or create derivative works of the T10 Services.

Furthermore, you may not use the T10 Services in any manner that could damage, disable, overburden, or impair Turbo10 Limited's Services. Should you wish to make commercial use of the T10 Services, you must enter into an agreement with Turbo10 Limited to do so in advance. 6. Intellectual Property
Intellectual Property Rights includes patents, inventions, know-how, trade secrets and other confidential information, registered designs, copyrights, data, database rights, design rights, rights affording equivalent protection to copyright, actual property rights (whether registered or unregistered) and all applications for the same anywhere in the world.

By agreeing to these Terms of Service you acknowledge that Turbo10 LImited own all rights, title and interest in and to the T10 Services. This agreement does not grant you any rights to patents, copyrights, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights, functions or licenses in respect of the T10 Services.

You agree not to modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the T10 Services. You also agree to not remove, obscure, or alter Turbo10 Limited's or any third party's copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the T10 Services.

7. Disclaimer of Warranties
You use T10 Services at your own discretion and risk. T10 Services are made available on an "as is" basis without warranties of any kind, either express or implied, including but not limited to any warranty of any kind or nature with respect to the nature, reliability, or accuracy of such services or any implied warranty of merchantability, fitness for a particular purpose or use and non-infringement of proprietary rights.

Turbo10 Limited hereby disclaims any responsibility for any harm resulting from your use of T10 Services. Turbo10 Limited makes no warranties whatsoever with respect to the T10 Services functionality, operability or use, that T10 Services will meet your needs and requirements, that the operation will be uninterrupted or error free.

Turbo10 Limited disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in the T10 Services.

Turbo10 Limited makes no warranties or representations in relation to any products, services, information, advice, or other material purchased or obtained by you through T10 Services or any advertisements on T10 Services.

You understand and agree that you download or otherwise obtain material or data through the use of the T10 Services at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download of such material or data.

8. Limitation of Liability
In no event will Turbo10 Limited be liable to you for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising out of or in connection with your use, inability to use, misuse or reliance upon, or from the interruption, suspension, or termination of T10 Services. This limitation shall also apply with respect to damages incurred by reason of other services, goods, information, advice received through or advertised on the T10 Services or received through any links provided in the T10 Services.

Under no circumstances shall Turbo10 Limited be liable to you for any damages whatsoever for the use of T10 Services including, without limitation, consequential, incidental or special damages or damages for lost profits or losses resulting from system interruption, non-performance or loss of data, even if advised of the possibility or likelihood of such damages.

9. Indemnification
You will indemnify and hold harmless Turbo10 Limited, its officers, employees, directors, representatives and agents, from and against any and all demands, claims, or liabilities.

10. Service Modifications and Termination
Turbo10 Limited may at any time change, delete, suspend or discontinue, temporarily or permanently, the T10 Services and restrict or terminate your access, any other user or any third party, to the website, without notice or liability.

11. Force Majeure
Turbo10 shall not be liable as a result of any delay, failure in performance or interruption of service, resulting directly or indirectly from acts of God, acts of civil or military authorities, civil disturbances, wars, strikes or other labour disputes, fires, transportation contingencies, interruptions in telecommunications or Internet services or network provider services, failure of equipment and/or software, other catastrophes or any other occurrences which are beyond such party's reasonable control.

12. Severability
If any part of this agreement is held to be illegal or unenforceable, the remainder of this agreement shall remain in full force and effect.

13. Waiver
Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by Turbo10 LImited.

14. Governing Law
The agreement shall be subject to English Law and any dispute shall be submitted to the non-exclusive jurisdiction of the English courts.

15. Entire Agreement
The terms and conditions set out in this agreement represents the entire terms agreed between parties. The section titles in this agreement are solely used for the convenience of the parties and have no legal or contractual significance.
